1. RISKS INHERENT TO THE ACTIVITY 

I acknowledge that I am aware of the risks inherent in the activities of Rouge & Diable.

The risks of the canoeing and kayaking activity I will be participating in are, more specifically, but not limited to: 

• Contact with water or drowning

• Cold, hypothermia, burns, heat-related disorders

• Injuries or cuts due to falls or other movements (sprains, strains, fractures, cuts etc.)

• Injuries resulting from accidental or unintentional contact between individuals and wild animals, etc.

• Blessures avec objet contondant ou coupant, (branches, matériel, etc.)​

2. RISK ACCEPTANCE

I am aware that the activities offered by Rouge & Diable take place in potentially rugged natural environments that are therefore further away from medical services. 

This could result in longer delays in the event of an emergency requiring evacuation, and consequently, a possible worsening of my condition or injury. Having been made aware of these risks and having had the opportunity to discuss them with a person in charge of the activity by telephone or in person, I acknowledge that I have been informed of the risks inherent in the activities and that I am able to undertake the activity in full knowledge of the facts and accepting the risks that the activity may entail. I also undertake to play an active role in managing these risks by adopting a precautionary attitude towards myself and others around me. I understand that I may leave this activity for any reason.

3. RELEASE FROM MATERIAL LIABILITY

I, the undersigned, hereby waive all claims for damages and interest for any damage to my property and equipment (normal wear and tear, loss, breakage, theft, vandalism etc.) resulting from my visit to Rouge & Diable

4. DRUGS AND ALCOHOL 

It is my responsibility not to use or be under the influence of any drugs, illegal substances or medications (prescription or not).

I also agree that I will not be under the influence of alcohol / be below the blood alcohol limit of 80mg per 100ml of blood, commonly known as "point zero eight" on arrival at Rouge & Diable, and that I will remain so for the duration of the activity. 

I am aware that any breach of these rules on my part could involve risks to my safety and that of others. Rouge & Diable cannot be held responsible for any incident or accident resulting from the consumption of alcohol, drugs, illegal substances or medication.

5. CONFIRMATION OF INFORMATION AND ACCEPTANCE OF RISKS 

I certify that the information given in this form is correct to the best of my knowledge. I certify that I have not deliberately omitted any information about my health status, whether relevant or not. I am aware that the information contained in this form is confidential and is intended to better plan and supervise the safety of the activities in which I will participate and that it will allow Rouge & Diable to draw up a profile of its clientele.

6. HEALTH STATUS

I certify that I do not have any medical condition that may pose an additional risk to my participation in canoeing and kayaking activities at Rouge & Diable (pregnancy, respiratory problems, heart problems, diabetes, severe allergies, uncorrected vision problems, deafness, etc.).

If I have a condition that may pose an additional risk to my participation in these activities, I undertake to meet with a Rouge & Diable supervisor on arrival and to inform him/her of this. After discussion with a responsible person from Rouge & Diable , if applicable, I accept the additional risk that could lead to a possible worsening of my health condition.

7. MISCELLANEOUS ACCEPTANCES

• I understand the safety instructions and agree to abide by them at all times.

• I do not do the activity if I have symptoms of COVID-19.

• I do not share my equipment with others during the activity.

• I respect the social distancing measures at the launch.

• I paddle alone in my boat or with a family member for double boats.

• I don't go on the water alone.

• I go to a body of water described by the attendant.

• I avoid grouping in backwaters or raft style.

• If the weather is bad, I avoid going on the water.

• I choose a package that matches my skill level and that I know.

• If a dangerous situation arises and an intervention must be made, I do not hesitate to do so even if it does not respect social distancing. I understand that I must first and foremost prevent any risk of drowning.

• I undertake to wear a life jacket at all times and to ensure that any minors accompanying me do the same.

• I have undergone all medical examinations that I believe are necessary to ensure that I am in adequate physical condition to use the hired equipment.

• Rouge & Diable does not guarantee the durability and efficiency of the rented equipment.

• Rouge & Diable cannot be held responsible for the durability of the equipment.

• I agree to pay the repair costs if I return the damaged equipment.

• I agree to pay the sale price of the equipment as determined by Rouge & Diable if the equipment is lost, stolen or destroyed.

• I am fully responsible for the rented equipment. I therefore assume all risks associated with the use of the rented equipment, whether these risks are foreseen or unforeseen, and I release Rouge & Diable from any liability for material damage resulting from the use of the rented equipment.

• I agree that photos and videos in which I can be identified may be used for promotional or advertising purposes by Rouge & Diable and its partners.

• Unless otherwise indicated by a parent or legal guardian, who will sign on the front of the contract, I declare that I am of legal age and legally entitled to sign the contract on my own behalf.

• If I am signing as a parent, legal guardian, I agree on behalf of the client identified above, to abide by all the terms of this contract; I agree to be jointly and severally liable under the contract; and I assume full responsibility for the safety of the client and the equipment hired.

• I agree to pay the rental fee for the equipment on signing this contract.

• I agree to pay the additional costs (late arrival, etc.), calculated according to the tariff of Rouge & Diable.
